Note: Members of Council and staff were present in the Municipal Office Council Chamber and the meeting was held via zoom, an electronic platform, for members of the public to attend.

Call to Order and Disclosure of Pecuniary Interest and the General Nature Thereof

Mayor McIver called the meeting to order at 1:00 p.m. and Council members were reminded to disclose any pecuniary interest and the general nature thereof that may arise during the meeting.

Councillor Golden stated the following: Please be advised that while I do not have a conflict of interest, I have decided to excuse myself from discussion or voting on Report 2023-01 the Gap as the report which is on our Feb 13 Agenda, specifically names a company owned by my sibling, and I wish to avoid any “perception” of conflict as per our Code of Conduct.

Ryan Stitt and Kirstin Tuckey appeared via Zoom. 

Council referred to the Lion’s Head Community Centre Redevelopment presentation from Salter Pilon contained within Agenda Item #15, Chief Administrative Officer Report No. CAO 23-04 Re: Lion’s Head Arena Project – Construction Management Proposal. 

Salter Pilon representative, Ryan Stitt, presented two approaches for the Lion’s Head Community Centre Redevelopment Project, Design Bid Build and Construction Management. 

Review of the following areas occurred as they relate to each approach. 

· Design Bid Build vs Construction Management

· Design Bid Build Schedule 

· Construction Management Schedule 

· Schedule Comparison

· Financial Implications 

Discussion ensued regarding the benefits to selecting the Construction Management approach.

It was noted that the Construction Management approach has become more prevalent since the beginning of the Covid-19 Pandemic regarding construction projects.

Mayor McIver thanked Ryan and Kirstin for their presentation, noting the CAO will follow up with Salter Pilon following the meeting.

Re: The Gap

Councillor Golden did not participate in the meeting at this time.

Deputy Mayor Anderson provided a brief history of The Gap.

Discussion ensued regarding Municipal Law Enforcement Officer Report No. MLEO 21-05.

It was noted that the The Gap is signed as no parking zone with no loading and unloading on the West side.

It was noted that The Gap will be included on Council’s Road Tour on Friday, April 28, 2023.

That Council approves the recommendation as presented and that the changes be included in the Traffic and Parking By-law No. 2023-10 for Council’s consideration and passage of the By-law on February 27, 2023, and 

That the following regulations remain status quo;

· Paid Parking in Tobermory remains status quo

· Parking and Paid Parking on Big Tub Road remain status quo 

· The Gap remains status quo 

· Resident 3 hour maximum parking on Grant Watson Drive remains status quo, 

· Resident/Cemetery 3-hour maximum Parking on Dunks Bay remains status quo, 

· Paid Parking at Dunks Bay remains status quo, and 

· ParkPass 4-hour Paid Parking reservation in the parking lot on Little Cove remains status quo, and

That the changes to Section 16 Sub 1 and Sub 2 of By-law 2023-10, Traffic By-law, be amended to reflect the following:

1. The Municipality will issue Resident Parking Passes per residential property owner(s) at no charge. The issuance of Resident Parking Passes will be issued for a person(s) residing, renting or leasing residentially on a full-time, year-round basis in the Municipality. Proof of residency will be required in the form of a valid photo identification issued by the Province of Ontario (such as a Driver’s Licence) and vehicle ownership. A Resident Parking Pass will be associated with a licence plate.

2. The Municipality will issue up to two (2) Resident Parking Passes per residential property for the residential property owner(s) at no charge. The issuance of a Resident Parking Pass will be issued for a person(s) owning improved property in the Municipality. A current-year tax bill and vehicle ownership are required, as each Resident Parking Pass will be associated with a licence.

3. The Municipality reserves the right to charge a $50.00 fee for persons requiring or requesting a Resident Parking Pass(es) if they do not meet the requirements set out in Sec 16 sub 1 and Sec 16 sub 2.

That Council directs staff to submit to the County of Bruce Planning and Economic Development Department, the Municipality’s position of no objection to a severance submitted by the agent, Ron Davidson, on behalf of the owner, Graham Brent Greig, for property legally described as 126 Main Street D1 UNIT 12 (Lion’s Head) and Con 5 EBR Pt Lot 29 and Con 5 EBR Pt Lot 30 (Eastnor) Municipality of Northern Bruce Peninsula; and

That Council approves the imposition of conditions of granting of consent as follows:

1. That the owner enter into an Agreement with the Municipality, if deemed necessary by the Municipality of Northern Bruce Peninsula to satisfy all the requirements, financial or otherwise of the Municipality, which may include, but shall not be limited to, the provision of parkland (or cash-in-lieu of land), roads, installation of services, facilities, drainage and the timing and payment of a development charge. 

2. That a Reference Plan (survey that is registered) be completed and a copy filed with the Municipal Clerk and a digital copy (preferred) or a hard copy be filed with the Approval Authority, or an exemption from the Reference Plan be received from the Approval Authority. 

3. That the Municipality provide written confirmation to the Approval Authority that the municipal conditions as imposed herein have been fulfilled. 

4. That, pursuant to Section 53(42) of the Planning Act, the ‘Certificate of Consent’ be affixed to the deed within two years of the giving of the Notice of Decision. (Note: Section 53(43) of the Planning Act requires that the transaction approved by this consent must be carried out within two years of the issuance of the certificate (i.e., Stamping of the deed)). 

5. That the applicant pays the applicable County of Bruce consent certification fee at the time of certification of the deeds. 

6. That the Clerk of the Municipality provide written confirmation that a development agreement has been executed and registered on title which identifies areas having high archaeological potential and outlines the following requirements prior to development or site alteration:

a. That an archaeological assessment be completed by an archaeologist licensed in the province of Ontario and confirmed by the appropriate Ministry to have been accepted into the Ontario Public Register of Archaeological Reports; and 

b. that the recommendations of the archaeological assessment (if any) have been implemented to the satisfaction of the zoning administrator.

Deputy Mayor Anderson inquired regarding installing signage on the bathrooms located in the Tobermory Community Centre Parking Lot.

Councillor Golden stated that compliance with the Short-term Accommodation By-law must be a priority for Council.

· Discussion ensued regarding the Short-term Accommodation Program and the need to get full compliance from STA Owners. 

Councillor Golden was concerned that Ferndale business owners are not eligible for Spruce the Bruce Funding. 

· The CAO noted that she would speak to Bruce County and Report back.

That Council directs staff to submit to the County of Bruce Planning and Economic Development Department, the Municipality’s position of no objection to a severance submitted by the agent, Ron Davidson, on behalf of the owner, Graham Brent Greig, for property legally described as 126 Main Street D1 UNIT 12 (Lion’s Head) and Con 5 EBR Pt Lot 29 and Con 5 EBR Pt Lot 30 (Eastnor) Municipality of Northern Bruce Peninsula; and

That Council approves the imposition of conditions of granting of consent as follows:

1. That the owner enter into an Agreement with the Municipality, if deemed necessary by the Municipality of Northern Bruce Peninsula to satisfy all the requirements, financial or otherwise of the Municipality, which may include, but shall not be limited to, the provision of parkland (or cash-in-lieu of land), roads, installation of services, facilities, drainage and the timing and payment of a development charge. 

2. That a Reference Plan (survey that is registered) be completed and a copy filed with the Municipal Clerk and a digital copy (preferred) or a hard copy be filed with the Approval Authority, or an exemption from the Reference Plan be received from the Approval Authority. 

3. That the Municipality provide written confirmation to the Approval Authority that the municipal conditions as imposed herein have been fulfilled. 

4. That, pursuant to Section 53(42) of the Planning Act, the ‘Certificate of Consent’ be affixed to the deed within two years of the giving of the Notice of Decision. (Note: Section 53(43) of the Planning Act requires that the transaction approved by this consent must be carried out within two years of the issuance of the certificate (i.e., Stamping of the deed)). 

5. That the applicant pays the applicable County of Bruce consent certification fee at the time of certification of the deeds. 

6. That the Clerk of the Municipality provide written confirmation that a development agreement has been executed and registered on title which identifies areas having high archaeological potential and outlines the following requirements prior to development or site alteration:

a. That an archaeological assessment be completed by an archaeologist licensed in the province of Ontario and confirmed by the appropriate Ministry to have been accepted into the Ontario Public Register of Archaeological Reports; and 

b. that the recommendations of the archaeological assessment (if any) have been implemented to the satisfaction of the zoning administrator.
