1. Call to Order and Disclosure of Pecuniary Interest and the General Nature Thereof

a. Mayor McIver called the meeting to order at 1:00 p.m. and Council members were reminded to disclose any pecuniary interest and the general nature thereof that may arise during the meeting.

2. Approval of the Agenda

5. Delegation

a. Bruce Peninsula Hospice Executive Director, Nancy Forgrave

Re: Updates on the Services and Supports Offered by Bruce Peninsula Hospice

Mayor McIver welcomed Bruce Peninsula Hospice Executive Director, Nancy Forgrave to the Council Meeting. 

Ms. Forgrave provided an overview of the Bruce Peninsula Hospice operations, highlighting that the organization has been supporting individuals and families on the Bruce Peninsula for the past 30 years.

Ms. Forgrave reported that the organization is supported by a team of 44 volunteers—31 dedicated to client care and 14 serving on the board or in supportive roles—along with 4 client care coordinators, 1 full-time staff member, and 4 part-time staff members.

An overview of the services provided by Bruce Peninsula Hospice was shared including bereavement support, in-home support, and Live Well at Home including Nav-Care. 

Mrs. Forgrave provided an overview of the upcoming Community Outreach and Engagement Sessions within the community, including the Community Conversation Event on Tuesday September 9, 2025, at the Tobermory Community Centre.

Members of Council thanked Nancy Forgrave for her presentation and thanked the Bruce Peninsula Hospice for their services.

b. Shelley Winch and Kenton Heslip

Re: Trailer Agreement for 18 Myles Dr

Councillor Sohrab joined the Council Meeting virtually via Zoom at 1:16 p.m. 

Mayor McIver welcomed Shelley Winch and Kenton Heslip to the Council Meeting.

Ms. Winch provided an overview of the conditions outlined in the previous Trailer Agreement for 18 Myles Drive and discussed the delays encountered during the construction of the dwelling, and provided an explanation regarding the utilization of a trailer as a short-term residence. 

Discussion ensued about the information contained within Building Department Report No. BD 25-05 Re: Expired Trailer Agreement, which was presented to Council on June 23, 2025. 

Council inquired about the anticipated completion date of the dwelling due to the delays experienced with construction. 

Mr. Heslip stated that construction is anticipated to be completed in October 2026. 

Mayor McIver noted that a staff report will be brought to the September 22, 2025, Council Meeting regarding the request by Ms. Winch and Mr. Heslip to extend their Trailer Agreement. 

Mayor McIver thanked Ms. Winch and Mr. Heslip for their delegation.

6. Consideration of Agenda Items

a. Public Works Manager Report No. PW 25-21 

Re: Fern Creek Municipal Drain Cleanout Tender

THAT Council receives Public Works Department Report PW 25-21 titled Fern Creek Municipal Drain Cleanout Tender, as information;

AND THAT Council awards the Fern Creek Municipal Drain Cleanout Tender to Collins Excavating for the amount of $28,028.33, excluding HST.

b. Municipal Law Enforcement Officer Report No. MLEO 25-09

Re: Extension of Paid Parking Season

Discussion ensued surrounding the information contained within Municipal Law Enforcement Officer Report No. MLEO 25-09. 

Council inquired about the number of visitors attending the parking areas following the Labour Day Weekend. 

Chief Bylaw Enforcement Officer, Carol Hopkins, advised that staff have observed reduced weekday visitation at the sites, although weekends remain consistently busy at the McCurdy Parking Area during favourable weather.

Discussion ensued regarding resource availability, particularly staffing requirements and the potential to extend the paid parking season at the McCurdy Parking area.

That Council receives MLEO 25-09 Extension of Paid Parking Season, and

That Council directs staff to extend the Paid Parking Season and Reservation Requirement for the McCurdy Parking Lot until October 15, 2025; and

That Council further directs staff to conclude the Paid Parking Season and Reservation Requirement for the Big Tub Road and Little Cove Road parking areas effective September 15, 2025.

Re: 2026 Schedule

THAT Council approves the 2026 Council Meeting Schedule as presented in report C25-22 – 2026 Schedule; and

THAT Council approves the 2026 Municipal Office Holiday closure as presented in report C25-22 – 2026 Schedule.

8. Correspondence

a. Ministry of Environment, Conservation and Parks (Information)

Re: Updates to Ministry of the Environment, Conservation and Parks’ Compliance Policy – Potential for Low-Risk Incident Referrals to Municipalities 

Council inquired about the capacity for municipal staff to address the referred incidents in the noted correspondence. 

Chief Administrative Officer, Peggy Van Mierlo-West, stated that municipal staff currently address items that pertain to Municipal By-laws.

Council directed staff to bring a report to Council with more information regarding the potential referrals of low-risk incidents to municipalities.

That Council move into a closed meeting at 1:53 p.m. with the CAO and Clerk in attendance pursuant to Section 239 (2) of The Municipal Act, 2001, as amended, for the following reasons: f) advice that is subject to solicitor-client privilege, including communications necessary for that purpose (Planning Matter); and c) A proposed or pending acquisition or disposition of land by the municipality (Arena Property Update).

b. Reporting Out

Mayor McIver reported out that Council met in closed session with the CAO and Clerk in attendance to discuss advice that is subject to solicitor-client privilege, including communications necessary for that purpose (Planning Matter); and a proposed or pending acquisition or disposition of land by the Municipality (Arena Update). Council approved the closed session minutes from August 25, 2025, and direction was given to the CAO and Clerk.
