Mayor McIver called the meeting to order at 1:00 p.m. and Council members were reminded to disclose any pecuniary interest and the general nature thereof that may arise during the meeting.

Zoning By-law Amendment Z-2023-076 (Sharma)

Bruce County Planner, Megan Stansfield appeared via Zoom at the November 14, 2023, Council Meeting. 

Mayor McIver welcomed Megan Stansfield to the November 14, 2023, Council Meeting. 

Megan Stansfield provided an overview of Zoning By-Law Amendment Z-2023-076 (Sharma), the following was noted; 

· The application proposes to amend the zoning from Rural (RU2) to Residential (R1). The change will align the zoning with the Local Official Plan. 

· The owners intent is to allow a short term accommodation as a permitted use on the subject lands, with the goal of adding the property to the area allowing short term accommodation as per By-Law 2021-84 and acquisition of a license in the future.

It was noted that a review of the Short-term Accommodation Licensing Program, with focus on the potential expansion of the program into rural zones will be occurs at the Council Meeting on Monday, November 27, 2023.

Zoning By-law Amendment Z-2023-076 agent, Bev Nicholson, appeared in person at the November 14, 2023, Council Meeting.

Bev Nicholson noted that no changes are proposed to the buildings existing on the property and that the intent of the application is to align with the Local Official Plan. 

Mayor McIver opened the meeting to members of the public at this time. 

No comments were received by members of the public.

Bruce Peninsula Health Foundation (BPHF), April Patry, BPHF Executive Director, Naomi Vodden, Director of Mental Health & Addictions Services, Brightshores Health System, Kevin Walsh, BPHF Chair

Re: Funding Proposal 

BPHF Executive Director, April Patry, and BPHF Chair, Kevin Walsh, appeared in person and Brightshores Health System Director of Mental Health & Addictions Services, Naomi Vodden, appeared via Zoom at the November 14, 2023, Council Meeting. 

BPHF Chair, Kevin Walsh, noted that the Municipality of Northern Bruce Peninsula has donated $552,000.00 to date and is greatly appreciative of the support from Council. 

Naomi Vodden presented to Council regarding the Grey Bruce Health Services Wellness and Treatment Centre. The following was noted: 

· The centre intends to transform addiction and mental health treatment through a first of its kind, purpose built facility dedicated to supporting individuals with additions and mental health needs through voluntary treatment, transitional living and life skills development.

· It is the first program of its kind in Canada to provide OHIP-covered wrap around Mental Health and Addictions services and supports.

· The program will specifically target individuals with an addition and mental health challenges that may or may not be ready to begin treatment.

· The program will develop patient-centred wrap-around supportive care programs filling current gaps in available mental health and addiction support. 

· The program will provide a longer-term residential program that combines Treatment and Recovery such as vocational and recreational activities.

· There will be up to 45 inpatients at a time, plus a unknown number of outpatients. 

BPHF Executive Director, April Patry, requested the Municipality of Northern Bruce Peninsula to invest $50,000 into the renovation and capitalization of Brightshores’ Wellness & Recovery Centre. 

Discussion ensued regarding the request by BPHF. 

It was noted the Wellness & Recovery Centre is anticipated to open prior to the end of January 2024. 

Discussion ensued regarding investment efforts for the Wellness & Recovery Centre.

Mayor McIver thanked April Patry, Kevin Walsh and Naomi Vodden for their presentations. 

Wes Rydall

Re: Arena Project

Wes Rydall appeared in person at the November 14, 2023, Council Meeting. 

Mayor McIver welcomed Wes Rydall to the Council Meeting. 

It was noted that the current arena in Lion’s Head was constructed approximately 40 years ago. Mr. Rydall proceeded to note concerns regarding the proposed renovations to the existing structure. He further stated that the construction of a new building would make more sense financially with respect to the anticipated repairs to the building in the coming years.

Discussion ensued regarding issues observed at the current Lion’s Head Arena location with respect to drainage and parking. 

Wes Rydall noted several options for a new location for the Lion’s Head Arena which would address the above noted issues. It was noted that a land owner south of Lion’s Head would be willing to sell 10 acres to the Municipality for $1,000,000 for the construction of the new arena. It was further noted that additional property owners have noted potential sales for the location of the building. 

It was further noted that a tour should occur to allow Council to see new the community centres that have been constructed within Grey and Bruce County’s. 

Discussion ensued regarding the stipulations associated with grant funds and their earmark to be utilized for renovations and additions to the existing structure.

It was noted that a change in the project at this point could result in the funding having to be returned to provincial and federal government agencies. 

It was noted that information surrounding alternative avenues for the Lion’s Head Arena Project, as discussed within Wes Rydall’s delegation, can be obtained for Council by staff.

That By-law No. 2023-93, Being a By-law to Authorize an Agreement for the provision of cellular devices and services between the Municipality and Rogers Communications Inc., be presented to Council for passage at its regular meeting on November 27, 2023.

It was noted that the anticipated start day for private plow/snow blowing contractors is December 1, 2023, with an anticipated end date of March 31, 2024. 

It was further noted that there is flexibility within this timeframe depending on weather conditions.

4. Fire Chief Report No. FC 23-07

Re: Community Emergency Preparedness Grant

It was noted that the grant is anticipated to cover the entire cost of the drones and associated training. 

It was noted by Fire Chief, Jack Burt, that verbal permission has been received from the national and provincial parks located within the Municipality of Northern Bruce Peninsula to utilize the drones to conduct emergency services within the associated areas. 

It was noted that a special operations licence would be required to operate the drones in proximity to the Tobermory Airport.

5. Chief Building Official Report No. BD 23-30

Re: By-law to provide for the Licensing, Regulating and Governing Food Truck Businesses

Discussion ensued regarding the pizza vending machine in Tobermory. 

It was noted that consideration should be given to the impacts associated with the pizza vending machine, such as waste. 

Discussion ensued regarding the recommended extension of the application deadline until March 1, 2024, for the first year of the program.

Discussion ensued regarding the potential to increase the number of food truck licences within the Municipality.

It was noted that the business community should be consulted prior to amending the number of licences allocated throughout the Municipality. 

It was noted that section 3.6 of Chief Building Official Report No. BD 23-30 should be removed as food trucks are not permitted on public property.

It was noted that Report No. BD 23-30 will be placed on Let’s Talk NBP for a period of 2 weeks following the November 14, 2023, Council meeting.

Discussion ensued regarding laundry facilities at the Lion’s Head Marina. 

The Parks and Facilities Manager noted that the Lion’s Head and Tobermory Marinas have the capacity to establish laundry facilities for marina users and the proposal will be included within the 2024 operating budget.

Deputy Mayor, Rod Anderson, commented regarding the OP Lindsay Tract Fire Emergency Scenario held by Fire Chief, Jack Burt, on November 2, 2023. 

It was noted that the scenario demonstrated a comprehensive overview of a potential emergency and the associated responses within the Municipality.

Mayor McIver noted that he attended the grand opening of the Tobermory Daycare. 

He further noted that the new facility demonstrates a key component of the community.

Mayor McIver noted his anticipated absence from the December 18, 2023, Council meeting.

Discussion ensued regarding the cancellation of the December 18, 2023, Council meeting.

“WHEREAS the Corporation of the Town of Rainy River is a small community in Northwestern Ontario with limited financial resources;

AND WHEREAS the Town of Rainy River owns and operates the water treatment facilities, water distribution facilities, wastewater treatment facilities and wastewater collection facilities which service the residents of the Town of Rainy River;

AND WHEREAS the Town of Rainy River requires Class II Water Treatment Operators for its facilities;

AND WHEREAS the Corporation of the Town of Rainy River attempts to provide training as prescribed by the Province of Ontario to obtain the necessary classification(s);

AND WHEREAS the Town of Rainy River has been fortunate in obtaining a full staff compliment eager to take on the responsibilities of water treatment and distribution and wastewater collection and treatment operations;

AND WHEREAS any new employees of the Town of Rainy River require certification;

AND WHEREAS training is becoming increasingly difficult to procure;

AND WHEREAS the Province of Ontario has implemented stringent review of water treatment plants to ensure compliance;

 AND WHEREAS the Province of Ontario is promoting and providing an increased number of training opportunities for a variety of trades;

BE IT HEREBY RESOLVED that the Corporation of the Town of Rainy River petitions the Province of Ontario to expand water treatment training opportunities for communities within Ontario;

AND FURTHER the training be delivered in a method that is flexible and affordable;

AND FURTHER utilize existing networks, such as Contact North, for on-line exam preparation and exam supervision;

AND FURTHER the Council of the Corporation of the Town of Rainy River forward copies of this resolution to Premier Doug Ford, Minister of Environment, Conservation and Parks Andrea Khanjin, MPP Greg Rickford, Walkerton Clean Water Centre, Ontario Municipalities.

That Council supports the following resolution from the Township of Clearview.

Whereas, municipal governments, as the democratic institutions most directly engaged with Ontarians need respectful discourse;

Whereas several incidents in recent years of disrespectful behaviour and workplace harassment have occurred amongst members of municipal councils;

Whereas these incidents seriously and negatively affect the people involved and lower public perceptions of local governments;

Whereas municipal Codes of Conduct are helpful tools to set expectations of council member behaviour;

Whereas municipal governments do not have the necessary tools to adequately enforce compliance with municipal Codes of Conduct;

Now, therefore be it resolved that the Township of Clearview supports the call of the Association of Municipalities of Ontario for the Government of Ontario to introduce legislation to strengthen municipal Codes of Conduct and compliance with them in consultation with municipal governments;

Also, Be It Resolved that the legislation encompass the Association of Municipalities of Ontario’s recommendations for:

• Updating municipal Codes of Conduct to account for workplace safety and harassment;

• Creating a flexible administrative penalty regime, adapted to the local economic and financial circumstances of municipalities across Ontario;

• Increasing training of municipal Integrity Commissioners to enhance consistency of investigations and recommendations across the province;

• Allowing municipalities to apply to a member of the judiciary to remove a sitting member if recommended through the report of a municipal Integrity Commissioner;

• Prohibit a member so removed from sitting for election in the term of removal and the subsequent term of office;

And that the above resolution be circulated to the Ministry of Municipal Affairs and Housing, MPP Brian Saunderson and all Ontario Municipalities.

That Council supports the following resolution from the Town of Huntsville.

WHEREAS: the Township of Georgian Bay and the Township of Lake of Bays has identified concerns with Floating Accommodations.

AND WHEREAS: the Township of Georgian Bay and the Township of Lake of Bays has requested that Transport Canada address the issue;

NOW THEREFORE, BE IT RESOLVED THAT: the Town of Huntsville supports Township of Lake of Bays Resolution #B(a)/04-12-22 and Township of Georgian Bay Motion C-2022-164 and C-2023-157;

AND FURTHER THAT: Council hereby directs staff to forward this Resolution to the Minister of Transport, the Premier of Ontario, Scott Aitchison – MP, Graydon Smith – MPP, Associations of Municipalities of Ontario (AMO) and all municipalities in Ontario (Township of Lake of Bays Resolution to be included in this correspondence).

Re: Automated Speed Enforcement systems

That Council supports the following resolution from the Town of Parry Sound.

Whereas speeding on Town of Parry Sound roads is a concern, and can occur in all areas of the community; and

Whereas barriers and delays to enforcement pose a danger to the community; and

Whereas the Town of Parry Sound has limited resources to implement speed mitigation road design and re-design; and

Whereas local police service has limited resources to undertake speed enforcement; and

Whereas s.205.1 of the Highway Traffic Act (HTA) provides that Automated Speed Enforcement systems (ASE) may only be placed in designated community safety zones and school safety zones,

THEREFORE BE IT RESOLVED THAT the Town of Parry Sound supports the request of the City of Cambridge that the Ontario Government amend s.205. 1 of the Highway Traffic Act (HTA) to permit municipalities to locate an ASE system permanently or temporarily on any roadway under the jurisdiction of municipalities and as determined by municipalities and not be restricted to only community safety zones and school safety zones; and

THAT a copy of this resolution be forwarded to the Ontario Minister of Transportation, the Ontario Minister of Municipal Affairs and Housing, MPP Graydon Smith, the Association of Municipalities of Ontario (AMO) and all Ontario Municipalities.

Following Closed Session, Mayor McIver advised that Council approved the minutes of September 11, 2023, Closed Session meeting and the CAO provided a verbal update with regards to 360-Degree Performance Review for a Municipal staff member.
