Council accepted the closed session minutes from October 14, 2025, and direction was given to the CAO.
7. Consideration of Agenda Items
a. Cobide Engineering – Stephen Cobean, Drainage Superintendent, and Amy Hoffarth, P. Eng
Re: Public Works Manager Report No. PW 25-23 – Section 78 Major Improvement Request, Judge’s Creek Municipal Drain
Mayor McIver welcomed Drainage Superintendent, Stephen Cobean and Amy Hoffarth from Cobide Engineering to the Council Meeting.
Amy Hoffarth provided Council with an overview of the Section 78 Major Improvement Request for Judge’s Creek Municipal Drain, including clarification on the process surrounding major improvements to a municipal drain, issues noted from an inspection of Judge’s Creek and recommendations for spot improvements.
Council engaged in discussion surrounding the associated cost to property owners within the Judge’s Creek Watershed.
Council asked for clarification regarding riffle pools found within Judge’s Creek.
Drainage Superintendent, Stephen Cobean, stated that riffle pools are clear stone placed in a cross section of a drain which act as dam.
Council asked about the drainage implications from the height of the Ministry of Transportation (MTO) culvert outlined within the report from Cobide Engineering.
Drainage Superintendent, Stephen Cobean, noted that the height of the drain is marked as an area of concern and further noted that, since the culvert was replaced by the MTO within the past 10 years, arranging for the culvert to be lowered could be challenging.
Council asked about the role of the Drainage Committee with regards to the report.
Mayor McIver thanked Mr. Cobean and Ms. Hoffarth for their presentation.

THAT Council receives report titled PW 25-23 Section 78 Major Improvement Request, Judge’s Creek Municipal Drain, as information; and
THAT Council accepts the recommendation from the Municipality’s Drainage Superintendent Stephen Cobean, Cobide Engineering Inc.; and
THAT the Request for a Major Improvement on Judge’s Creek Municipal drain under section 78 of the Drainage Act shall not be accepted; and
THAT Council directs the Drainage Superintendent to proceed with the maintenance items as recommended.

Re: Public Works Manager Report No. PW 25-22 – Notice of Request for Drain Minor Improvement, Judges Creek Branch E – Weigel
Amy Hoffarth provided Council with an overview of a Minor Request for Improvement to establish a crossing for a farm where Branch E of Judge’s Creek runs diagonally through the property.
Mayor McIver thanked Ms. Hoffarth for her presentation.

THAT Council receives report PW 25-22 titled Notice of Request for Drain Minor Improvement, Judges Creek Branch E – Weigel, as information;
AND THAT Council accepts the Request for Drain Minor Improvement, Judges Creek Branch E – Weigel and authorizes the Clerk and Drainage Superintendent to take the appropriate actions to proceed with an Engineer’s Minor Improvement Report under Section 78 of the Drainage Act;
AND THAT the Clerk forwards a Notice advising of the proposed drainage works to applicable agencies and other prescribed persons as per Section 78(2) of the Drainage Act;
AND THAT Council appoints Amy Hoffarth, P. Eng., of Cobide Engineering Inc. as the Drainage Engineer to complete the Minor Improvement Report under Section 78 of the Drainage Act.

Re: Treasurer Report No. TR 25-16 – Audited Financial Statements
Mayor McIver welcomed Robyn Strangway-Calder and Traci Smith to the Council Meeting.
Ms. Strangway-Calder provided Council with an overview of the draft audited financial statements for 2023 and 2024 including the statement of financial position, statement of operations and accumulated surplus, and comparisons to previous years statements.
Council asked about the budgeted total cost acquisitions.
Mayor McIver thanked Robyn Strangway-Calder and Traci Smith for their presentation.

That Council accepts the quotation bid dated October 16, 2025 from 2042578 Ontario Ltd., (operating as Lawn and Lawn Landscape Contractors) in the amount of $235,887.71 + HST for reconstruction of concrete stairs, ramp, and retaining wall works at the Tobermory Library and Ferndale Red Schoolhouse Gallery; and
That Council directs staff to bring forward an agreement for the restoration and replacement of trees as may be necessary along the property line with the abutting landowner.
