Due to technical difficulties, Mayor McIver called the meeting to order at 1:11 p.m. and Council members were reminded to disclose any pecuniary interest and the general nature thereof that may arise during the meeting.

Ontario Senior of the Year Award
Recipient: Sharron Coulter
Sharron Coulter was presented with the Ontario Senior of the Year Award, acknowledging her many valuable contributions to the community.
It was noted that Sharron’s work with the Grey Bruce Seniors Without Walls program was a huge benefit to the seniors especially during the COVID-19 lockdown.
Mayor McIver noted that the Senior of the Year Award gives the Municipality of Northern Bruce Peninsula the opportunity to honour an outstanding individual for the contributions she has made to enrich the social, cultural, and civic life within the community.

Zoning By-law Amendment Z-2022-039 – 104 Bay Street South
Public Meeting – June 27, 2022

Having declared a pecuniary interest, Councillor Mielhausen did not participate in this portion of the meeting.
Bruce County Planner, Megan Stansfield, was present via Zoom and provided an overview of the proposed Zoning By-law Amendment Z-2022-039 for 104 Bay Street South
It was noted that the purpose of the application is to amend the R1 – Detached Residential zoning of the entire property to C1A-62–2022 Commercial with a special provision to permit and limit the use of the property as a rental cottage establishment.
Within the Planning Analysis, it was noted that the existing residential zoning on the property does not permit the use of the single family detached dwelling as a rental cottage establishment. Additionally, the properties south of 104 Bay Street are zoned residential, while the properties north are zoned commercial. It was further noted that the Blue Heron Company owns and operates the properties at 106, 107, 109 and 112 Bay Street as a part of Wireless Bay Cottages. Megan Stansfield indicated that these properties are all zoned C1A, to permit the use of the dwellings as rental cottages and that the proposal is to change the zoning of 104 Bay Street South to be consistent with the other properties owned by the company.
It was clarified that the Grey Sauble Conservation Authority identified natural hazard features on the property associated with the flood and erosion hazard of Georgian Bay, being the 100-year flood lake level and the wave uprush. It was further noted that no development is proposed within these features so, the proposal is considered consistent with the Provincial Policy Statement.
It was noted that no public or agency comments were received prior to the Public Meeting.
Councillor Golden noted that she was not aware that the Tobermory Harbour Boardwalk could be extended in this area. Ms. Stansfield stated that if the proposed land was developed that one of the stipulations would involve Site Plan Control and the dedication of a Right-Of-Way if the boardwalk was ever extended.
Mayor McIver opened the public meeting up to members of the public at this time.
Helen Chen appeared via zoom and inquired regarding the grandfathering clause contained within the Short-term Accommodation By-law if their property was sold to individuals who wished to operate a Short-term Accommodation.
It was noted that Short-term Accommodations that existed prior to the implementation of the Short-term Accommodation By-law and are located in zones that are not eligible for a Short-term Accommodation Licence, are able to be “grandfathered” into the Licence by providing proof of previous rental under their ownership. It was further noted that these grandfathered licences are non-transferable if the property is sold.
It was noted any questions regarding the zoning of a property within the Municipality of Northern Bruce Peninsula should be directed to the Municipality’s Chief Building Official, Wendy Elliott.
Receiving no further public comments, Mayor McIver closed this portion of the public meeting at this time.

Mayor McIver introduced the Public Meeting under the Planning Act and noted if anyone from the public is interested in this application or wishes to receive a notice of the decision, they must make a written request and you can do that by sending an email to genevieve@cuestaplanning.com He explained that members of the public should note that the ability to appeal the decision on this amendment may be limited if they have not provided comment on the amendment prior to the decision.
Cuesta Planning Consultant, Genevieve Scott was present via Zoom and provided an overview of the Amendment to the Official Plan for Tobermory, Lion’s Head and Ferndale and Comprehensive Zoning By-law Housekeeping Amendment to Council.
She indicated that the purpose of the Amendment to the Official Plan for Tobermory, Lion’s Head and Ferndale and Comprehensive Zoning By-law Housekeeping Amendment is to include provisions related to the following land uses in accordance with Official Plan Amendment C-2021-015 as well as provincial legislation;
• Boathouses
• Docks
• Food Trucks
• Mini-Storage
• Shipping Containers
• Additional Dwelling Units
• Garden Suites & Tiny Homes
• Private Guest Cabin
• Tourism Cottage
• Tents, Trailers and Recreational Vehicles
• Farmer’s Market
• Lighting
It was further noted that the amending by-law also incorporates new definitions for “Columbarium”, “Short Term Accommodation” and “Water Closet”, as well as provisions for reducing the required gross habitable floor area in the RU1, R1, R2 and R3 zones and waive minimum habitable gross floor area requirements for existing undersized lot in the RU1, R1 and R2 zones, and provisions for Additional Dwelling Units (ADUs).
At this time, Cuesta Planning Consultant, Genevieve Scott, reviewed the agency and public comments submitted for the June 27, 2022 regular Council meeting.
Municipality of Northern Bruce Peninsula Attainable Housing Task Force:
Provided recommendations regarding Additional Dwelling Units (ADUs) as it pertains to property servicing requirements, ADU provisions for agricultural areas, minimum gross floor area, setback requirements, entrance separation of ADUs from primary dwellings, parking requirement consideration, environmental protection zone consideration, and registration of ADUs with the Municipality.
The Attainable Housing Task Force also submitted recommendations pertaining to Tiny Homes, indicating that Tiny Homes should be permitted as a primary residence as opposed to the current recommended definition of Tiny Homes that would allow them to be utilized as ADUs.
Jaimy Hunt:
Proposed that the provisions contained within the Amendment to the Official Plan for Tobermory, Lion’s Head and Ferndale and Comprehensive Zoning By-law Housekeeping Amendment be extended to C-1a zoning in Tobermory to facilitate a means of alleviating the constraints on the current lodging supply, both permanent and seasonal.
Fred Kaizer:
Provided suggestions, clarifications, and comments pertaining to the definitions for boathouses and docks. He noted that the current definitions for boathouses and docks appear to be comprehensive, demonstrating potential issues regarding applications and permits resulting from the implementation of the by-law.
A second item of correspondence was received from Mr. Kaizer after the agenda for the June 27, 2022 regular Council meeting was posted. The comment submitted to the Chief Building Official, Wendy Elliot, included additional comments on Section 6.3.10 “Docks” IV, regarding consistency with the other sections of the “dock” segment contained within the by-law.
Kevin Doyle:
Provided comments on several areas contained within the by-law such as Boathouses, Docks, Shipping Containers, Additional Dwelling Units, and Tiny Homes.
Comments surrounding boathouses and docks encompassed height, setback, and minimum frontage requirements as well as increasing square footage provisions for a boathouse and provisions surrounding the construction of boathouses and docks on vacant waterfront lots.
Comments submitted pertaining to shipping containers encompassed the provisions included within the by-law as it relates to the size and height and eligibility of shipping containers permitted within certain zones.
He further noted, regarding ADUs, that consideration should be given within agricultural areas regarding the distance requirements for buildings contained within the farm cluster. It was also noted that ADUs should be permitted within all residential zones, permitted that lot size permits the inclusion of an ADU.
Final comments surrounding Tiny Homes encompassed the proposed inclusion of mobile homes within the by-law provisions currently associated with Tiny Homes.
H-F Burns:
Requested clarification regarding the proposed 4000 sq. metres requirement contained within the by-law regarding ADUs.
Brent Robins (Received on June 26, 2022 via email):
Presented concerns regarding the proposed exclusion of boathouses in commercial zones as well as the exclusion of docks in C3 Resort Commercial and C4 Travel Trailer Park and Commercial Campground zones.
He further spoke regarding the Comprehensive Zoning By-law Amendment as it relates to the restriction of docks being installed parallel to the side lot line as well as the proposed minimum shoreline frontage requirements
Glenda Clarke:
Emphasized the corresponding benefits associated with the implementation of the Comprehensive Zoning By-law Amendment within the Municipality of Northern Bruce Peninsula as it pertains to attainable and affordable housing.
Ms. Scott also noted minor comments from the Bruce County Planning Department regarding agricultural areas, which she intends to follow up on. In addition to the comments received from Bruce County Planning Department, Ms. Scott indicated that similar comments had been received from Grey County.
Mayor McIver requested further clarification on the concern proposed by Brent Robins as it relates to the restriction of docks being installed parallel to the side lot line.
Genevieve Scott indicated that as long as the required setbacks are met regarding adjacent lots, no issues should arise regarding the construction of a dock that is not installed parallel to the side lot line.
Clarification was provided regarding the minimum gross floor area of an undersized lot. Genevieve Scott further stated that the intent of this provision within the Comprehensive Zoning By-law Amendment is for the creation of more affordable housing options.
It was noted that an undersized lot is defined as a lot that is comprised of less than 4000 sq. metres for Ru1/ Ru2 zones as per the County Official Plan.
Discussion ensued regarding the square footage provisions contained within the Comprehensive Zoning By-law Amendment as it relates to boathouses.
Discussion ensued regarding the Ministry of Natural Resources’ (MNR) issuing of permits with regard to the construction of docks or shoreline work. It was noted that the MNR does not have any thing to do with docks under 15 sq. metres
It was noted that property owners are able to property owners who own both sides of the road, with water front access on the one side, are permitted to construct a boathouse on the vacant side of the road subject to the compliance of provisions within the Building Code.
Discussion ensued regarding the provisions surrounding ADUs as well as the comments submitted by Jaimy Hunt regarding the inclusion of the provisions contained within the Comprehensive Zoning By-law Amendment within Commercial Zones that are currently utilized as residential properties.
It was noted that further review from the Municipality of Northern Bruce Peninsula’s Building Department would be required regarding the inclusion of ADUs within Commercial Zones that are being utilized as residential properties.
Discussion ensued regarding the implementation of ADUs on agricultural land. It was noted that the construction of ADUs on agricultural land will not be considered as future consent to sever land.
Genevieve Scott noted that the provisions included within the Comprehensive Zoning By-law Amendment indicate a farm cluster for these scenarios to ensure that all ADUs constructed on agricultural land are located within a certain proximity to the principle dwelling.
Mayor McIver stated that any questions relating to the eligibility of an area to construct an ADU should be directed to the Municipality’s Chief Building Official, Wendy Elliott.
Mayor McIver opened the Public Meeting to questions from members of the public.
Karen Phillips appeared in person and inquired regarding the capacity of the Building Department to issue the permits generated by the implementation of the Comprehensive Zoning By-law in addition to the permits currently issued by the Municipality, including sewage, building, renovation and plumbing. She further commented on the carrying capacity of the Bruce Peninsula as it relates to the establishment of ADUs, servicing requirements for ADUs and Garden Suites, attainable housing strategies, and compliance issues with the Short-term Accommodation By-law
Mayor McIver noted that full compliance is difficult to achieve during the first season following the passing of the Short-term Accommodation By-law and that the Municipality is focusing on the education of property owners regarding the requirement of a Short-term Accommodation Licence. He further stated that the By-law Department is actively working to ensure compliance of Short-term Accommodations within the Municipality of Northern Bruce Peninsula.
Chief Building Official, Wendy Elliott, noted that, with respect to sewage, all properties are required to have a sewage permit as well as demonstrating that the servicing requirements as stated within the Building Code are met. She further noted all properties will be reviewed and followed up on before an ADU is permitted on a lot.
Councillor Mielhausen noted the Lakewood Subdivision only permits a maximum of four bedrooms per dwelling as per their agreement and this should be investigated.
Discussion ensued regarding restricting the number of ADUs within the Municipality. Chief Building Official, Wendy Elliott, noted that the issuing of permits relating to the establishment of ADUs would be dependent on the properties ability to obtain proper servicing for the structure. Genevieve Scott noted that Bruce County Planning is restricting the number of ADUs permitted on shoreline areas and on inland lakes which is reflected primarily in the R2 zone. She further stated that only one ADU is permitted per parcel in the R2 zone and that it is required within the principle dwelling.
Karen Phillips further commented on the significant development and removal of trees on lots throughout the Municipality.
Mayor McIver noted that individuals can contact Bruce County regarding concerns towards the removal of trees.
Councillor Myles noted that the requirement of servicing permits for buildings allows the Municipality to adapt to changing servicing requirements as well as to monitor future development of ADUs.
She further noted that the current housing market within the Municipality is unfavourable in terms of attainability and affordability. Councillor Myles stated that the ability of individuals to construct smaller single family dwellings would facilitate lower construction and heating costs for individuals who wish to live within the Municipality full time or seasonally.
Brenda Stewart appeared in person and requested clarification regarding the provisions contained within the Comprehensive Zoning By-law Amendment as it pertains to minimum gross habitable square footage.
It was noted that existing undersized lots, located in RU, R1 and R2 zones would have the minimum gross habitable square footage waived, subject to the proposed dwelling adhering to Building Code requirements.
It was further noted that all zones, R1, R2, R3, RU1 and RU2, will have their minimum gross habitable square footage requirements reduced from 1000 to 750 square feet.
Chief Building Official, Wendy Elliott, stated that alternative servicing options will be considered for Tiny Homes subject to compliance with the Building Code.
Julie Wardrope attended via Zoom and requested zoning information pertaining to a Dyer’s Bay Property.

Chief Administrative Officer, Peggy Van Mierlo-West, indicated that the Municipal Innovation Council (MIC) is focusing on the development of more inclusive projects for all municipalities contained within the MIC.

Discussion ensued regarding the proposed operation of the Lion’s Head Shuttle Service with consideration of the traffic observed within the area in recent weeks.

Other Business
Councillor Myles commented on the McCurdy Parking Lot located on Moore Street in Lion’s Head. It was noted that due to the capacity limit of the McCurdy Parking Lot, that individuals are beginning to park on lower Moore Street. Councillor Myles suggested that signs with the corresponding ParkPass QR Codes be placed along lower Moore Street to accommodate for the influx of parking.
Councillor Myles indicated that Tamara Wilson from the Bruce Trail Conservancy has requested a letter of support from Council regarding a nomination for the Harvard James Award for one of the Conservancy members.
Councillor Myles inquired regarding the Status of the Downtown Revitalization project. It was noted that the Chief Administrative Officer is brining a report to the July 11, 2022 Council meeting regarding the Downtown Revitalization Project.
Councillor Myles proposed a question regarding the application process for local groups to receive funding from the Community Service Fund. Chief Administrative Officer, Peggy Van Mierlo -West noted that a letter must be sent to the Clerk before going to Council regarding a request for funding.
Councillor Myles stated that the inconsistent cell service within the Municipality is concerning from an Emergency Management Standpoint. Proposed avenues of improvement were discussed by Council.
