DISCLOSURE OF PECUNIARY INTEREST AND GENERAL NATURE THEREOF

Mayor McIver called the meeting to order at 9:11 a.m. and Council members were reminded to disclose any pecuniary interest and the general nature thereof that may arise during the course of the meeting.

CONSIDERATION OF AGENDA ITEMS

1. Manager of Community Services Report No. CS 20-32

RE: Status of Municipal Facility Closures in accordance with Provincial Order(s) – COVID-19

Mr. Deska, Manager of Community Services, advised that the Premier announced yesterday that marinas will be reopening to the public as of 12:01 a.m. on Saturday, May 16, 2020. Mr. Deska recommended that the Municipal marinas stay closed at this time as staff need time to prepare for the reopening. He did suggest that boat launches can be reopened for day use only.

Councillor Mielhausen asked if the Lion’s Head Marina could be reopened as it is a Federal harbour. Mr. Deska stated that the Federal government had closed marinas until June 1, 2020; however, he received an email that indicated that they are in agreement with the Province regarding reopening and can reopen anytime as of May 16, 2020. 

Councillor Golden questioned if a seasonal slip holder launches his/her boat at either the Lion’s Head or Tobermory Harbour may he/she leave the boat in the Harbour. Mr. Deska clarified that he recommends day use only at the harbours.

Councillor Myles commented on the boat launches reopening without any Municipal staff being present over the weekend. Mr. Deska informed Council that by-law staff would periodically visit the boat launch sites to ensure that users are abiding by regulations, but that no staff will be directly supervising the site. Councillor Myles questioned if by-law staff have the capacity to monitor the boat launches this upcoming weekend. Mr. Deska indicated that limiting the boat launches to locals only would impose a heavy staff burden. Councillor Golden expressed that she does not think that by-law staff should be required at the boat launches.

Deputy Mayor Myles asked if permitting residents to utilize boat launches is inclusive of cottagers. She questioned how staff will limit the number of people at the launches. Mr. Deska recommended that boat launches be open to the general public and signage be installed asking users to abide by Provincial regulations and avoid gatherings. 

Councillor Myles expressed that she is only in support of opening the Lion’s Head and Tobermory Marinas if staff are present.

Councillor Golden mentioned that individuals launching their boats are likely to be only those fishing early morning and there is no serious health issue imposed. 

Deputy Mayor Myles inquired on washroom availability for the weekend. Mr. Deska noted that all washrooms will remain closed until marinas reopen. He said that he will be training marina/harbour staff next Wednesday on cleaning and safety procedures. Councillor Golden mentioned that there are two (2) portable toilets in downtown Tobermory. Deputy Mayor Myles suggested being prepared in both Tobermory and Lion’s Head. Mr. Deska indicated that he could order a portable toilet for Lion’s Head.

THAT all boat launches in the Municipality be opened effective 12:01 a.m. on Saturday, May 16, 2020 with the provision that a portable washroom be provided at the Lion’s Head Harbour prior to that particular launch being opened.

Councillor Golden asked what the plan is for the reopening of the marinas. Mr. Deska informed Council that the lift-in dates will remain as May 25, 2020 for the Tobermory Harbour and May 30, 2020 for the Lion’s Head Marina. He stated that staff need at least one week to prepare for the opening with all of the changes regarding COVID-19. Councillor Myles suggested that the marinas open on their corresponding lift-in dates and Council concurred. 

Deputy Mayor Myles asked if cash payments will be limited at the marinas. Mr. Deska said that debit and credit payment will be the only means of payment permitted during the pandemic. Deputy Mayor Myles said that the Tobermory Harbour office may not be large enough to accommodate social distancing of 6 feet. Mr. Deska recommended that there be a limit of one (1) person inside at a time and he has ordered a plexiglass barrier to install, if needed.

Councillor Myles asked if the Bruce Trail parking lots will be open this weekend. Mr. Deska advised that the parking lots should be opened if the Bruce Trail is open. 

2. By-law Enforcement Officer Report No. 20-07

RE: Reinstating Paid Parking

Mayor McIver stated that it is too early to reinstate paid parking. Councillor Golden was in agreement and said that she would be interested in knowing if the Tobermory Chamber of Commerce was consulted.

Councillor Myles suggested that staff should consult with businesses regarding paid parking and noted that it was suspended as an economic recovery measure.

3. Chief Administrative Officer Report No. CAO 20-14

RE: Appointment By-law

Mrs. Van Mierlo-West stated that, after reviewing the organizational chart, there appeared to be some gaps in legislative duties. She said that it is in the best interest of the Municipality to appoint a Deputy Clerk and Deputy Treasurer in case there is an outbreak or a long absenteeism.

THAT Council receive the report titled Appointment By-law for information.

THAT Council approve appointment By-law No. 2020-58 and By-law 2020-59.

OTHER BUSINESS

Councillor Golden requested that a formal notice be drafted that clearly indicates the opening dates for the marinas to avoid any confusion. The CAO advised that she is preparing a media release that will encompass reopening dates for the marinas that will be emailed to stakeholders to post on social media pages. She noted that some media releases are broadcast on radio stations and next month, the Municipality will hopefully have an active social media account.

Councillor Golden noted that the County has lifted the fire ban, but the Municipal fire ban remains in effect. She called upon Mrs. Addison, Deputy Clerk, on this matter to which Mrs. Addison replied that the Provincial fire ban will be lifted as of 10:00 a.m. on Friday, May 15, 2020.
